TubeDisk Terms of Service — user rights and obligations, responsibility, license, copyright procedures.

1. Acceptance

By accessing or using TubeDisk (the "Service") at https://tubedisk.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Nature of Service

2.1. TubeDisk is a neutral technical tool — comparable to a browser or file manager. The Service provides technical means to retrieve publicly available video and audio content from third-party sources (YouTube, TikTok, Instagram, VK, Rutube, Facebook, Twitter/X, Twitch, public Telegram channel links) and deliver it directly to the user's selected cloud storage (Google Drive, Yandex.Disk, Dropbox, S3-compatible storage).

2.2. Ephemeral processing. TubeDisk does not host, store, or distribute the downloaded content as a content repository. The Service streams data from the source to the destination cloud and retains transient buffers only for the duration of the transfer. Once a transfer completes, the content is not retained on TubeDisk servers as long-term storage.

2.3. The Service does not moderate, curate, vet, or endorse the downloaded content. The user is solely responsible for content selection, the legality of that selection in the user's jurisdiction, and any further use of the content after transfer.

2.4. TubeDisk does not act as a "content sharing service provider" under the Digital Services Act, Article 17 of the Copyright in the Digital Single Market Directive, or comparable legislation. The Service does not store user-uploaded content and does not optimize content for distribution to the public.

3. Account Registration

3.1. Some features require account registration. You agree to provide accurate, current information.

3.2. You are responsible for maintaining the confidentiality of your account credentials.

3.3. By registering, you confirm that you are of legal age under the laws of your country of residence. If your jurisdiction does not explicitly define the age of majority, the minimum age to use the Service is 18 years.

4. License to Use

4.1. We grant you a non-exclusive, revocable, non-transferable license to access the Service for personal, non-commercial use.

4.2. You must not:

  • use the Service to infringe copyright, trademark, or other intellectual property rights;
  • distribute malware, spam, or fraudulent material through the Service;
  • interfere with the Service's operation (DDoS, scraping, reverse engineering);
  • resell access to the Service without written permission;
  • use the Service in violation of applicable laws.

5. User Responsibility for Content

5.1. You are solely responsible for the legality of any content you transfer through the Service, including but not limited to:

  • compliance with copyright and related rights of the content owner;
  • compliance with the source platform's Terms of Service;
  • age restrictions applicable to the content;
  • compliance with the laws of your jurisdiction (including but not limited to copyright, broadcasting, defamation, and obscenity laws).

5.2. The Service provides technical means only and does not endorse, vet, or take a position on content choices made by users.

5.3. When downloading content marked by the source as age-restricted (18+), you additionally confirm you are of legal age under the laws of your country of residence.

5.4. Prohibition on circumvention of Technological Protection Measures (TPM). You must not use the Service to attempt to circumvent any technological measure (including but not limited to digital rights management ("DRM") systems such as Widevine, PlayReady, or FairPlay) protecting copyrighted content. The Service does not provide DRM-circumvention functionality, and any attempt to use the Service for that purpose violates these Terms and applicable laws including the U.S. Digital Millennium Copyright Act §1201, Article 6 of the EU Copyright Directive (2001/29/EC), and Article 1299 of the Russian Civil Code.

5.5. Indemnification. You agree to indemnify, defend, and hold harmless the Service operator and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • your use of the Service in violation of these Terms;
  • your selection of content to transfer (including any claim that the content infringes a third party's rights);
  • your breach of any applicable law in connection with use of the Service;
  • any false or misleading information you provide to the Service.

6.1. We respect intellectual property rights.

6.2. If you believe content downloaded via the Service infringes your copyright, you may send a written notice ("DMCA Notice") to <dmca@tubedisk.com> or <support@tubedisk.com> containing:

  1. a physical or electronic signature of the copyright owner or authorized agent;
  2. identification of the copyrighted work claimed to be infringed;
  3. identification of the material allegedly infringing (URL or video ID);
  4. your contact information (address, phone, email);
  5. a statement of good faith belief that the use is not authorized;
  6. a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

6.3. We will respond to valid DMCA Notices in accordance with 17 USC §512.

6.4. Designated Agent for DMCA Notices. Notices may be submitted to <dmca@tubedisk.com>. We are in the process of registering a Designated Agent with the U.S. Copyright Office under 17 USC §512(c)(2); until that registration is complete, email submission remains the primary channel.

6.5. Counter-notification. If you believe content was removed by mistake or misidentification, you may submit a counter-notification under 17 USC §512(g) to the same address, with the required statements.

6.6. Repeat Infringer Policy. Pursuant to 17 USC §512(i), we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers:

  • First valid DMCA notice against your account results in a written warning and removal of the user's ability to re-transfer the specific identified content.
  • Second valid DMCA notice within a 12-month period results in temporary suspension (up to 14 days) of the user's account.
  • Third valid DMCA notice within a 12-month period results in permanent termination of the account.
  • A "valid DMCA notice" means a notice that meets the formal requirements of §6.2 above and that has not been successfully counter-notified by the user within 14 days.

6.7. Submission of false DMCA notices is a violation of 17 USC §512(f) and may result in liability for damages.

7. Plans and Payment

7.1. The Service offers tiered plans (FREE, Pro, Ultra) with varying usage limits. Current plan details are available at Pricing.

7.2. At the time of these Terms' publication, online payment is temporarily unavailable. Paid plans are activated manually via <support@tubedisk.com>.

7.3. Refunds, when payment is available, will be processed according to applicable consumer protection laws.

8. Disclaimer of Warranties

8.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

8.2. We do not warrant:

  • uninterrupted, error-free operation;
  • that content downloaded to your cloud storage will remain accessible;
  • compatibility with any third-party source (sources may change APIs or restrictions).

9. Limitation of Liability

9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE SERVICE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

10. Termination

10.1. We may suspend or terminate your access for violation of these Terms.

10.2. You may delete your account at any time via account settings or by emailing <support@tubedisk.com>.

11. Modifications

11.1. We may modify these Terms. The current version is available at /terms.

11.2. Material changes will be notified by email or via Site notification.

12. Governing Law and Jurisdiction

12.1. These Terms are governed by the laws of the jurisdiction where the Service operator is established.

12.2. Disputes shall be resolved in the courts of competent jurisdiction.
